What is Franchise Law?
Franchise Law is extremely complex and can have significant variation from state to state. Experienced franchise and business attorneys can be invaluable in helping to navigate the nuances of franchise law. We are proud to offer services representing franchisors and franchisees.
What is a franchise?
According to the International Franchise Association, a franchise is a relationship between two parties where the franchisor distributes products or services involving a business system with a brand and/or tradename (franchisor) to a franchisee who pays a royalty and often an initial fee for the right to do business under the franchisor's name and system.
Under a franchise system the franchisee is given the right to promote and sell products or services associated with the franchisor’s trademark. The franchisor has the authority to dictate the franchisee’s methods of business and is legally able to exert a significant amount of authority over the franchisees operations.
According to Statistica, the United States had a total of 773,603 franchises as of 2019. Franchises carry tremendous economic impact to local communities while activity from entrepreneurs buying and operating franchises boost hiring and economic development.
Why do I need a franchise attorney?
A franchise attorney can help prospective businesses navigate the complex process necessary to start a franchise. Here are a few reasons why hiring a franchise attorney is a valuable part of starting your business.
We know what is important
According to the federal and state laws, all potential franchisees must receive a lengthy Franchise Disclosure Document (FDD) to review prior to buying a franchise. This document provides disclosures of information that help guide a franchisee’s decision about their investment. Our firm understands the intricacies of the FDD and Franchise Agreement from both the franchisor and franchisee’s perspective and can help franchisor’s prepare their FDD, as well as review FDD’s for franchisees.
